REGULAR MEETING

OCTOBER 4, 2016

5:00 P.M.
A regular meeting of the North Wildwood City Council was held in the afternoon of the above date in the City Hall. The President of Council stated, “The meeting is now open. Adequate notice of this meeting has been provided by posting a copy of the revised notice of the time and place of this meeting on the City Clerk’s bulletin board and by mailing a copy of the same to The Herald, The Press and Wildwood Leader on March 2, 2016.”
ROLL CALL: Present were Mayor Patrick Rosenello, President of Council Salvatore Zampirri, Councilpersons Edwin Koehler, Margaret Bishop, Kellyann Tolomeo, James Kane, David Del Conte and Joseph Rullo. Also present were City Administrator Kevin Yecco, Solicitor William Kaufmann and Engineer Ralph Petrella.
MINUTES: On a motion by Bishop, seconded by Rullo, that the minutes of the regular meeting of September 20, 2016 be approved as read. Carried.

NJ DIVISION OF LOCAL GOVERNMENT SERVICES – CY2016 BEST PRACTICES INVENTORY QUESTIONNAIRE: The City has provided sufficient correct responses on this State-wide questionnaire to maintain the highest level of State Aid available.
On a motion by Koehler, seconded by Rullo, that the above CY2016 Best Practices Questionnaire be accepted, received and filed with the State of New Jersey by the CFO as required by law. Carried.
ORDINANCES:
ORDINANCE NO. 1705 - On a motion by Koehler, seconded by Del Conte, that Ordinance No. 1705 be placed on its second reading. Carried.
The City Clerk read Ordinance No. 1705 by its title, as required by Law, known as “An Ordinance Amending Ordinance 334, As Amended By Ordinance 1416, Concerning Beach Rules And Regulations, And As Amended By Ordinance 1424, Concerning Operation Of Motor Vehicles Upon The Beach During Specified Dates And Times“.
This Ordinance has been published according to Law, posted on the City Clerk’s bulletin board with copies available in the City Clerk’s Office on request.
The President of Council stated this was the time and place to hold a public hearing on Ordinance No. 1705 and asked if anyone present had any objections to the passage of this Ordinance. Hearing none, he then asked the City Clerk if he had received any objections in writing, the City Clerk stated none, the President of Council declared the hearing closed.
On a motion by Tolomeo, seconded by Koehler, that Ordinance No. 1705 be passed on its second reading and published according to Law, the roll being called, all voting in the affirmative, the President of Council declared Ordinance No. 1705 duly adopted.
ORDINANCE NO. 1706 - On a motion by Rullo, seconded by Kane, that Ordinance No. 1706 be placed on its first reading. Carried.
The City Clerk read Ordinance No. 1706 by its title, known as “An Ordinance Amending Ordinance 360, As Amended And Codified In Section 292-4 Of The Code Of The City Of North Wildwood, Pertaining To Mercantile License Fees“.
On a motion by Tolomeo, seconded by Kane, that Ordinance No. 1706 be passed on its first reading and published according to Law, the City Clerk called the roll, all voting in the affirmative, the President of Council declared Ordinance No. 1706 passed on its first reading.

RE: Awarding Contract To Mobile Concepts Specialty Vehicles For A Fire Training Trailer

The above resolution was offered by Rullo, seconded by Kane, the roll being called, all voting in the affirmative, the President of Council declared the resolution duly adopted. Mayor Rosenello stated that with a USDA Grant and various fundraising efforts by the Fire Department, this trailer will be purchased at no cost to the City.

RE: Determining The Form And Other Details Of Not Exceeding $16,500,000 General Improvement Bonds, Of The City Of North Wildwood, In The County Of Cape May, New Jersey, And Providing For Their Sale To The New Jersey Environmental Infrastructure Trust And The State Of New Jersey And Authorizing The Execution And Delivery Of Loan Agreements To Be Executed By The City And Each Of The New Jersey Environmental Infrastructure Trust And The State Of New Jersey, Acting By And Through The Department Of Environmental Protection And Further Authorizing The Execution And Delivery Of An Escrow Agreement Pursuant To The New Jersey Environmental Infrastructure Trust Financing Program

RE: Authorizing An Agreement With Middle Township For The Provision Of Road Striping Services In Return For Payment Of Labor And Supplies


The above resolution was offered by Rullo, seconded by Tolomeo, the roll being called, all voting in the affirmative, the President of Council declared the resolution duly adopted. Administrator Yecco stated that Middle Township will pay all costs associated with using the City’s line striper. North Wildwood will train Middle Township personnel to use the equipment, the cost of training to be borne by Middle Township, and Middle Township employees will perform the work.
FINANCE/VOUCHER LIST:
On a motion by Bishop, seconded by Del Conte, authorizing payment of all approved vouchers. Carried. As per Resolution #11-16, all bills listed below be paid and warrants drawn by the proper officers for the stated amounts.

COUNCIL:

COUNCILMAN DEL CONTE stated that the Survivor’s Weekend ceremony was a wonderful event.

MAYOR ROSENELLO stated that North Wildwood OEM does a great job in keeping the residents informed. Anyone needing to sign up for the emergency notifications should go to the website, ready.northwildwood.com.

PUBLIC:
CHARLES BRACKETT, 115 E. 1st Avenue, stated that the noise coming from Keenan’s is out of control. When Keenan’s came before the Planning Board the neighbors expressed concern that the noise would be bad. Those concerns have been realized. There is not supposed to be amplification of music but now they have at least four large amplifiers outside. They were supposed to have someone controlling the noise level of the music, but that person was let go after just two weeks on the job. Who is responsible for enforcing the Planning Boards resolutions? The noise ordinance states that they should not be dumping their cans and bottles between 10pm and 7am, but they are always dumping their bottles and cans into the dumpsters at 1am. There is too much noise there. They should not be dumping cans and bottles until the next day. Who can enforce the noise ordinance? Brackett calls the Police Dept. often but if they do not witness the dumping then they cannot issue a citation. This noise must stop. The Police try to help. There is also a horrible smelling liquid running out of Keenan’s dumpsters across the parking lot and into the street. This is probably a health hazard. This is food, beer and other liquors running into the storm drains. This should not be happening. Who can take care of this problem, the County Health Department? The smell is terrible and it is actually discoloring the sidewalks. The sidewalks are also crumbling and broken. Who will inspect these sidewalks? The people in the neighbor need help with this situation. There must be health violations there. Brackett has been in his house 40 years. Please help us.
JOHN CHAMBLEY, 119 E. 1st Avenue, stated that his family has been in this house for almost 100 years. The Police Department is very helpful and responds to every call, but they do not witness the dumping of the bottles and cans at 1am. There should be enclosures around the trash dumpsters to keep the noise down. Tenants in Chambley’s rental unit suffer with noise and smell. Keenan’s needs to do something about this situation. Please help.
MAYOR ROSENELLO stated that the Zoning Officer and the Police Chief will look into the situation. Rosenello asked Chief Gallagher to meet with Messrs. Brackett and Chambley after the meeting.
