Primary/Secondary Vendors
The primary vendor will provide service to all users within the defined geographical regions, unless an agency seeks a DOA waiver, in which case the secondary vendor will become the service provider. DOA will only approve a waiver for using a secondary provider for reasons of service quality. In the event the secondary vendor is unable to deliver quality service or there is not an agreement with a secondary vendor, alternate vendors may be considered.

Wisconsin statutes (s. 16.73, Wis. Stats.) establish authority to allow Wisconsin municipalities to purchase from state contracts when the contractors agree to extend their terms to them. Municipalities (local governments) use the service to expedite purchases. A “municipality” is defined as any county, city, village, town, school district, board of school directors, sewer district, drainage district, vocational, technical and adult education district, or any other public body having the authority to award public contracts (s. 16.70(8), Wis. Stats.).
Local governments may purchase and receive the State Rate Plan. Variation in other terms and conditions listed in Amendment #2.

Suspected Fraud (cloning)
Contact Vendor account representative or Customer Support Center as quickly as possible. If cloning fraud is detected a corrective course of action will be recommended (e.g., suspend service, replace telephone, change telephone number, etc.). Invoice will be credited if cellular fraud occurs.
Lost Or Stolen Telephones
Contact Vendor account representative or Customer Support Center as quickly as possible. A corrective course of action will be recommended (e.g., suspend service, replace telephone, change telephone number, etc.).
Vendor will provide cellular telephone numbers that are local to user’s primary employment location. There may be a few exceptions, especially in rural areas.
Cellular Equipment
Basic equipment (handset, carrying case, headset, battery, AC adapter, DC adapter) provided by vendor remains vendor owned. Vendor is responsible for maintenance, repair, removal and disposal of vendor owned equipment throughout the term of the contract.
Users requiring alternate equipment may opt for a one-time equipment credit to be applied to the retail list price of other equipment. Credit is available only at the time of account activation. Equipment purchased by the State remains the property of the State.
Should the State of Wisconsin elect to extend the agreement from its original 3-year term, Vendor shall provide a one-time replacement of all equipment in use by State agencies and local governments that has been in service more than 12 months, as well as provide new basic equipment for newly activated accounts. Replacement of equipment is at the discretion of the purchasing agency. Users requiring alternate equipment may opt for a one-time equipment credit to be applied to the retail list price of other equipment. Credit is available only during the year-4 equipment replacement process.
