  1. OPTUS MOBILE BROADBAND SERVICE TETHERED MODEM OPTION

    1. iPhone as Modem access, Double Data & Modem Access and Bus iPhone as Modem access (also referred to as tethered modem) and Mobile Internet Packs



      1. What is the iPhone as Modem access or Modem access and Double Data & Modem Access or Bus iPhone as Modem access and Mobile Internet Packs used for and how does it work?

        1. iPhone as Modem access, Double Data & Modem Access and Bus iPhone as Modem access enables you, if you are an eligible consumer or small or medium business customer, to use your iPhone as a tethered modem. A tethered modem refers to the use of a mobile phone as a modem when connected to a computer or laptop, enabling connection to the internet over a mobile network. The connection to the computer or laptop may be either with cables or wireless. Use of a mobile phone as a tethered modem requires both an active mobile service together with iPhone as Modem access or Modem access and Double Data & Modem Access or Bus iPhone as Modem access. If you require additional data you can purchase a Mobile Internet Pack.

        2. iPhone as Modem access, Double Data & Modem Access and Bus iPhone as Modem access allow you to access the Internet from your Optus 3G network compatible handset. The following handsets are approved for use on the Optus 3G (2100Mhz) network:

      1. How do you activate/de-activate iPhone as Modem access or Double Data & Modem Access Bus iPhone as Modem access?

          You can activate and de-activate iPhone as Modem access or Double Data & Modem Access or Bus iPhone as Modem access:

        1. in our Optus World and Dealer stores; or

        2. by contacting Optus Customer Service.

      2. Are there any limitations or restrictions on using iPhone as Modem access or Double Data & Modem Access or Bus iPhone as Modem access?

        1. The service is only available within Optus 3G (2100Mhz) coverage areas and is subject to network availability.

        2. There is no included data amount in iPhone as Modem access or Bus iPhone as Modem access.

        3. Circuit Switched Data and Fax is excluded from iPhone as Modem access, Double Data & Modem Access and Bus iPhone as Modem access.

        4. Mobile as Modem data packs are only available to iPhone customers on an eligible iPhone rate plan when iPhone as Modem access or Bus iPhone as Modem access has been selected.

        5. iPhone as Modem access, Double Data & Modem Access and Bus iPhone as Modem access is only available if you are billed by our ‘Arbor’ billing system. You can find out if you are being billed by our Arbor billing system by contacting Customer Service.

    1. Special liability

      1. We make no warranty about the accuracy, timing or content of any information provided via iPhone as Modem access, Double Data & Modem Access or Bus iPhone as Modem access and Mobile Internet Packs. You rely on any information provided via iPhone as Modem access Double Data & Modem Access or Bus iPhone as Modem access at your own risk and should seek independent advice where appropriate.

      2. We accept no liability for any loss or damage as a result of a delay in receiving information via iPhone as Modem access, Double Data & Modem Access or Bus iPhone as Modem access, or information provided not being secure or not received.

      3. You indemnify us against any loss or damage suffered or incurred, directly or indirectly, as a result of reliance upon any information received via iPhone as Modem access, Double Data & Modem Access or Bus iPhone as Modem access.

    2. Fees and charges

      1. Consumer customers

In addition to iPhone as Modem access (see below), tethered modem use will count towards your included data limit that is built into your mobile service rate plan. On Double Data & Modem Access, tethered modem use will count towards your included data limit that is built into your mobile service rate plan and any additional data included with your Double Data & Modem Access. Additional data can be purchased by taking a Mobile Internet Pack. Excess usage is charged at 35c per MB. If you use the enabled SIM card in an alternate device, usage may not be included in your included data allowance and may be charged at the prevailing rate. (Refer to Appendix Y – Mobile Value Added Service Features.)

      1. Small and medium business customers

In addition to Bus iPhone as Modem access (see below), tethered modem use will count towards your included data limit that is built into your mobile service rate plan. Additional data can be purchased by taking a ‘yes’ Business Data bolt-on. Excess usage is charged at 35c per MB or 15c per MB if you have a ‘yes’ Business Data bolt-on. If you use the enabled SIM card in an alternate device, usage may not be included in your included data allowance and may be charged at the prevailing rate. (Refer to Appendix Y – Mobile Value Added Service Features.)

    1. iPhone as Modem access, Double Data & Modem Access and Bus iPhone as Modem access pricing table (for iPhone V3.0 and later software versions and handset models)

          iPhone as Modem access, Double Data & Modem Access and Bus iPhone as Modem access is offered month to month and is available to customers on an eligible iPhone plan.

          For consumer customers who add iPhone as Modem access from 21 June 2009, this pricing is only available for a limited time and is a promotional offer and subject to change.

  1. WIRELESS CONNECT 3G OPTION

    1. Equipment Charges

If you have purchased an approved 3G PC Data Card or USB Modem from us:

      1. By agreeing to pay the full purchase price upfront, we will bill you for the purchase price in your first bill; or

      2. By paying the purchase price over an agreed equipment term in accordance with clause 6.3(c) of the service description¸ we will bill you the monthly equipment charge each month for the length of the equipment term.

    1. Service Charges

      1. How do we calculate data usage?

        1. We will charge you for the volume of data uploaded and downloaded using the service.

        2. Charges are based upon 1 kilobyte increments and are rounded to the nearest cent.

        3. Charges for part of a 1 kilobyte increment will be rounded up to the next 1 kilobyte increment.

        4. There are 1024 kilobytes for every 1 megabyte.

      2. Which pricing plan applies to you?

        1. If you have already completed your application for the service the name of your pricing plan will be indicated on your application. If you do not know the name of your pricing plan you may call us to confirm your pricing plan details.

        2. The pricing plans for the service are set out in the table below.

        3. You may select a minimum term of either 12 or 24 months in your application, or you may choose a non-fixed length agreement.

        4. You must pay us the monthly access fee for the pricing plan you choose each month during the term of the agreement. The monthly access fee includes an amount of eligible data usage, as indicated in the table. We will bill you for monthly access fees in advance.

        5. Eligible data usage includes Optus Wi-Fi network (3G PC Data Card only), Optus 3G network and Optus GSM network data use. The following are not included in eligible data use: data use when you are roaming.

        6. Excess usage charges will apply for each extra kilobyte of data uploaded or downloaded (or part thereof) once you have reached your monthly Data Allowance for that particular billing period. We will bill you for excess usage charges in arrears.

        7. Any unused included data usage is forfeited at the end of each month.

      3. What charges apply for your use of value added service features?

Appendix Y (Value Added Service Features) of the agreement describes the value added service features that are available with the Optus Digital Mobile Service. Where you use such value added service features in connection with the service, unless we specify otherwise, the charges set out in Appendix Y will apply to your use of value added service features

Optus Wireless Connect Employee Plan

        1. The Optus Wireless Connect Employee Plan is only available under special offers to full time or part time employees of our corporate or government business customers

        2. if you cease to be employed by our corporate or government business customer, you may be transferred to another pricing plan at our discretion.

        3. You may connect a maximum of two (2) services to this pricing plan. Any additional services may be transferred to another plan at our discretion.

    1. Cancellation fees

      1. If the service is cancelled before the expiry of the minimum term, you will be required to pay us:

        1. any usage charges incurred up to, and including, the cancellation date; plus

        2. the cancellation fee set out in the table below (unless under clause 2A of the consumer terms or SMB terms (as applicable to you), you are entitled to cancel the service without incurring a cancellation fee); plus

        3. the sum of unpaid equipment charges owing on your 3G PC Data Card or USB Modem(if any); plus

        4. the sum of unpaid equipment charges owing on your Notebook Equipment Payment Plan as specified in Appendix DD (if any).

      2. The cancellation fee is calculated as a fixed amount if the service is cancelled:

        1. during the first 6 months of the minimum term if you are connected on a 12 month minimum term; and

        2. during the first 12 months of the minimum term if you are connected on a 24 month minimum term; and

then a pro-rata reduction of that fee (indicated as a percentage in brackets in the first column of the table below) if the service is cancelled during the second year (or in the case of a 12 month minimum term, second 6 months) of the minimum term.
