The terms set out below apply if you connect to the service on or after 12 December 2010 on a Data Cap pricing plan and you purchase an approved device, or you connect to the service with your own compatible Mobile Broadband modem or embedded device such as a computer or tablet with an inbuilt 3G modem after 12 December 2010
If you purchase an approved device through Optus:
pay the entire amount for the cost of the device upfront, in which case we will bill you for the purchase price in your first bill, or
pay for the cost of the device by paying a fixed amount each month over the equipment term (see Appendix D for more details) in accordance with clause 5.3(d) of the service description, in which case we will bill you the monthly equipment charge each month for the length of the equipment term.
Details of and the purchase prices for the devices vary from time to time and are available from us and our participating agents.
Paragraph (i)(A) below refers to the mobile equipment payment plan so that the length of the equipment term we will agree to depends upon the length of the minimum term of the pricing plan you select.
The equipment term we will agree to is 12 if the agreement is a fixed length agreement with a 12 month minimum term.
